3. Eligibility

To use our services, you must:
  • Be at least 18 years old (or the age of legal majority in your jurisdiction).
  • Have the legal capacity to enter into binding contracts.
  • Comply with all applicable laws, regulations, and these Terms.
We reserve the right to refuse service to anyone for any reason, including (but not limited to) suspected fraud, violation of laws, or behavior that conflicts with our business interests or values.

4. Fees and Payments

4.1 For Property Owners

  • Management Fees: You agree to pay a management fee for our services, which may be a percentage of monthly rent, a flat rate, or a combination of both. The exact fee structure will be specified in your Property Management Contract.
  • Additional Costs: You are responsible for reimbursing us for third – party expenses related to your property (e.g., maintenance repairs, tenant screening fees, marketing costs). We will provide itemized invoices for these expenses.
  • Payment Terms: Fees and expenses are due and payable as outlined in your contract. Late payments may incur interest charges (e.g., 20% per month) or service suspension/termination.

4.2 For Tenants

  • Rent Payments: You agree to pay rent in full and on time, as specified in your lease agreement. Late rent may result in fees (e.g., 20% of the monthly rent) and could lead to eviction proceedings.
  • Security Deposit: You may be required to pay a security deposit to cover potential damages or unpaid rent. The deposit amount and terms (e.g., refund conditions) will be detailed in your lease agreement.
  • Application Fees: A non – refundable application fee may apply to cover tenant screening costs (e.g., background checks, credit reports).

5. Responsibilities

5.1 Property Owners

  • Property Compliance: You must ensure your property complies with all local, state, and federal laws (e.g., safety codes, habitability standards).
  • Accurate Information: You agree to provide complete and accurate information about your property, including any known defects, hazards, or legal obligations.
  • Insurance: You must maintain adequate property insurance and provide proof of coverage to us. We are not liable for damages not covered by your insurance policy.

5.2 Tenants

  • Property Care: You must keep the property clean and undamaged, except for reasonable wear and tear. Report maintenance issues promptly.
  • Lease Compliance: You must follow all terms of your lease agreement (e.g., occupancy limits, pet policies, quiet hours).
  • Legal Compliance: You must abide by all laws and regulations related to your use of the property (e.g., noise ordinances, waste disposal rules).

6. Lease Agreements

All tenancies are governed by a written lease agreement. The lease will include key terms such as:
  • Rent amount, due date, and payment methods.
  • Lease duration (e.g., fixed – term or month – to – month).
  • Security deposit details (e.g., amount, refund conditions).
  • Maintenance responsibilities (yours and the landlord’s).

7. Termination

7.1 By Property Owners

  • You may terminate our management services with 7 days’ written notice, as specified in your contract. You remain responsible for fees and expenses incurred before termination.
  • Early termination may require payment of a fee (e.g., 7 months’ management fees) to cover costs like re – marketing the property or transitioning management.

7.2 By Tenants

  • You may terminate your lease early only if permitted by your lease agreement. Early termination typically requires:
    • Written notice (e.g., 7 days’ notice).
    • Payment of an early termination fee (e.g., 7 months’ rent).
    • Finding a replacement tenant (subject to approval) or paying rent until a new tenant is placed.

7.3 By SU Luxe Ltd

  • We may terminate services with written notice if:
    • You violate these Terms or your contract.
    • Providing services becomes illegal or unsafe.
    • You fail to pay fees or cooperate with our reasonable requests.

8. Liability and Indemnification

8.1 Limitation of Liability

  • We are not liable for:
    • Damages caused by tenants, third parties, or “acts of God” (e.g., natural disasters).
    • Losses from property value changes, market fluctuations, or uncollected rent (except as required by your contract).
    • Errors in tenant screening or property management that do not result from our gross negligence or intentional misconduct.

8.2 Indemnification

  • You agree to indemnify and hold us harmless from:
    • Claims, damages, or losses arising from your property (e.g., tenant injuries, legal disputes).
    • Your violation of laws, lease terms, or these Terms.
    • Disputes between you and tenants or third parties.

9. Privacy

10. Dispute Resolution
